These terms cover your use of the ShellPal iPhone app. The short version: it’s a care companion, not a vet, and subscriptions are handled by Apple.
ShellPal is published by The ShellPal team (“we”, “us”). By downloading or using the app, you agree to these terms and to Apple’s Licensed Application End User License Agreement (the “Standard EULA”). If the two conflict, these terms apply, except where the Standard EULA must take precedence.
Not veterinary advice
ShellPal helps you keep track of care. The turtle’s mood is a care status: it shows how up to date your logged care is, not how healthy your turtle is. Default care schedules, daily facts and assistant answers are general information only.
Nothing in the app is veterinary advice, and it isn’t a substitute for a qualified reptile vet. If you’re worried about your turtle’s health, contact a vet. You’re responsible for your animal’s care.
Your licence to use the app
We give you a personal, non-exclusive, non-transferable licence to use the app on Apple devices you own or control, as allowed by the App Store’s Usage Rules. Don’t copy, modify, reverse engineer or resell the app, or use it in a way that breaks the law or interferes with the service.
Your data
Everything you add stays yours. It’s stored on your device and in your iCloud account, and we don’t have access to it (see the Privacy Policy). Syncing and backups rely on iCloud, so keep iCloud turned on if you want your data on other devices. We aren’t responsible for data lost because of your device, your iCloud account or Apple’s services.
Subscriptions
Some features, such as the AI assistant, need a paid subscription (“Premium”). The price and billing period are shown in the app before you buy.
- Payment is charged to your Apple Account when you confirm the purchase.
- Subscriptions renew automatically unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for the renewal within 24 hours before the period ends.
- You can manage or cancel your subscription in Settings → your name → Subscriptions. Cancelling stops the next renewal; you keep Premium until the end of the period you’ve paid for.
- If a free trial is offered, any unused part of it ends when you buy a subscription.
- Refunds are handled by Apple under its policies. You can request one at reportaproblem.apple.com.
- Use Restore Purchases in the app’s Settings to unlock Premium on a new device or after reinstalling.
Premium may include limits, such as a monthly number of assistant questions. Any limits are shown in the app. We may change what Premium includes or its price. A price change won’t affect a period you’ve already paid for, and Apple will tell you before it applies to a renewal.
The AI assistant
Answers are generated by an AI model from your question and your turtle’s details. They can be incomplete or wrong, so use your judgement and check anything important with a vet. The assistant won’t diagnose conditions or recommend medications or doses.
Don’t use the assistant to create content that is illegal, harmful or abusive, or try to get around its limits or safety rules. We may suspend access to the assistant if it’s being misused.
Changes and availability
We’re always improving the app, so features may change, and some may be added or removed. We try to keep the app and the assistant available, but we can’t promise they’ll always work without interruption. If we change these terms in a meaningful way, we’ll update this page and the date at the top, and tell you in the app where appropriate.
Disclaimers and liability
The app is provided “as is” and “as available”. To the extent the law allows, we don’t give any warranties, and we aren’t liable for indirect or consequential losses, or for anything that happens because you relied on the app instead of a vet. Nothing in these terms limits rights you have under consumer law that can’t be limited.
Governing law
These terms are governed by the laws of the country where the publisher is established, without affecting any mandatory consumer protections in the country where you live.
